HIT AND RUN ATTENDED
Washington recognizes two types of Hit and Run; Those cases where someone was present and those cases where no one was around. Conviction for Hit & Run Attended will also lead to a license suspension.
If you are driving a motor vehicle and strike another car or damage property, RCW 46.52.020 lays out your requirements. You are required, among other things, to stop immediately and stay at the scene of the
accident until all driver information - including name, insurance, address AND render reasonable assistance to the person injured (if any). Failure to perform your duties under RCW 46.52.020 is a gross misdemeanor.
Fighting the Charge
If you find yourself facing a charge like this, talk to an attorney immediately. You may be facing civil liability as well as criminal. There are several potential defense, but we will need to talk about the facts of what happened
to see if they apply.
Licensing Consequences
If you get convicted of Hit and Run (attended) then you will lose your license for 1 year. After the first 90 days has run, you can apply for an Occupational Restricted License (ORL), as long as you have no other suspensions on your
driving record.
Can I contest or appeal the revocation?
Yes, you may request an administrative review within 15 days from the date on your suspension letter. The suspension letter DOL sends to you includes a form to request a review of the suspension.
How can I get my license back?
When you are eligible to reinstate your driver license, you must:
* file future proof of financial responsibility, also known as an SR-22, for 3 years from the date you are eligible to reinstate your driver license for that incident.
* pay a $75 reissue fee, in addition to any other licensing fees, the next time you apply for a Washington driver license.
