TOP QUESTIONS

1.  Will I lose my license just because I got arrested?  No.  The law requires a hearing and an opportunity to be heard before the government can take your property from you.

2.  If I feel that I am guilty, should I plead Guilty at Arraignment?  Absolutely not!  Once you plead Guilty, the Court will move immediately to sentencing.  Contrary to common sense, the Court will not "take it easy" on you because to confessed to breaking the law.  The reality is often quite the opposite.  By pleading Not Guilty initially, we get a chance to work with the Prosecutors and try and negotiate for a better sentencing recommendation.  It is even possible in some cases to reach an agreement with the Prosecutor to keep a conviction off your record.

3.  What's the worst that can happen to me?  I get this question a lot.  The better question is: What is likely to happen to me? However, to answer everyone, if you are charged with a Gross Misdemeanor then the maximum is 1 year in Jail and a $5,000 fine.  If you are charged with a simple Misdemeanor then the maximum is 90 days in Jail and a $1,000 fine.  Unless you have an extensive criminal history or there are outrageous facts in the current charge, no one gets the maximum on a first offense.

4.  How much does it cost to hire a lawyer?  Never be afraid to ask a lawyer how much his or her bill will be.  Most criminal defense attorneys charge a flat fee based on the nature of the charge against you.  Call me and let's discuss your case.  Once I know more about what happened, I can get you a price quote.  I do not charge money until you decide to hire me.

5.  If I have a Public Defender, can I still get a Private Attorney? Yes.  In fact, it's very common for people to start out with a Public Defender then hire a Private Attorney to take over.  Neither the Judge nor the Public Defender will be upset about this process; it happens all the time.
